Recommendations for Rates and Engagement of Contract Staff and Employees as Pilates Method Instructors

These recommendations have been developed with reference to the following awards:

Fitness Award (2010); Sporting Organisations Award (2010); Health professionals & Support Services Award (2010); Miscellaneous Award (2010).

Rates of pay: Studio Instruction with a recommended instructor to client ratio of 1:4 maximum

Contract Staff

Level 1 $25.00 – $30.00 per hour
Level 2 $31.00 – $35.00 per hour
Level 3 $35.00 – $49.00 per hour
Level 4 $50.00 – $55.00 per hour
Principal $55.00 – $59.00 per hour
Trainer $65.00 upwards per hour based on experience

 

Full-time Employees
A full-time instructor will be required to work a thirty-eight (38) hour week. Within the 38-hour week a maximum of 32 would be instruction of clients, with the remaining 6 hours to be filled by administrative tasks directly related to the instruction and management of clients within the studio/centre.

Level 1 $39,520.00 per annum
Level 2 $49,400.00 per annum
Level 3 $59,282.00 per annum
Level 4 $69,160.00 per annum
Principal $79,000.00 per annum
Trainer $79,000.00 per annum and above

Part-time Employees
Part-time employees should be engaged at a pro-rata rate based on recommendations as per 1.2

Rates of pay: Matwork/Group Fitness Instruction

 

Client to instructor ratio will be determined according to instructor level, given as follows:

Matwork 1yr Maximum 8:1

2-5yr Maximum 12-15:1

Level 1 Maximum 10:1
Level 2 Maximum 15: 1
Level 3 and 4 Maximum 20:1
Principal Maximum as for L3 or with spotters for greater numbers
Trainer As for Principal

 

Recommended ranges for rates of pay relevant to Matwork/Group Fitness Instruction are:

Leading Instructor Rate (being the instructor engaged to give lead instruction for class or group)

Matwork $35.00 – $85.00 per session

dependant on experience

Level 2 $35.00 – $45.00 per session
Level 3 $50.00 – $65.00 per session
Level 4 $65.00 – $85.00 per session
Principal $85.00 – $120.00 per session
Trainer As for Principal and additional based on experience

 

Assisting Instructor Rate (being an instructor engaged to assist or spot for the leading instructor)

Level 1 $10.00 – $15.00 per session
Level 2 $15.00 – $20.00 per session
Level 3 $20.00 – $30.00 per session
Principal $30.00 – $50.00 per session
Trainer $40.00 – $60.00 per session

Recommended Minimum Industry Conditions Applicable to Employment/Contract Position


Payment of wages/invoices

  • Staff must be notified in writing, upon engagement, as to when wages/fee payment will be made. (ie: Weekly, fortnightly, monthly on which day)
  • Staff must be notified in writing, upon engagement, as to how wages/fee payment will be made. (ie: transfer to bank account)
  • Staff must be notified in writing, upon engagement, as to their obligations for receipt of wages/fees. (ie: time, date and procedure for submission of Invoice or Timesheet)

Shift breaks

  • A break of no less than fifteen (15) minutes for every five hours worked. An instructor should not work in excess of five hours without a fifteen-minute break.

Insurances

  • Employers must procure and maintain the following insurance policies as a minimum
    • an appropriate Workers Compensation policy to cover all employed staff. Contractors will not be covered by the organization’s Workers Compensation policy.
    • an appropriate Public Liability policy relevant to the lease and/or size of operations to cover all staff and persons attending the place of operations
  • Instructors must procure and maintain a Malpractice/Personal Indemnity policy as a Pilates Method Instructor to a minimum cover of $10,000,000.00 in any one claim and $20,000,000.00 in the aggregate.
  • Contractors must procure and maintain their own Workers Compensation policy to cover themselves.

Taxation

  • Employees must have PAYG taxation withheld by the employer and submitted to the Australian Taxation Office in accordance with standard ATO requirements.
  • Employees must complete for the employer an ATO PAYG declaration form upon The employer will provide the declaration to the employee for completion.
  • Contractors will be responsible for all their own taxation obligations.

Superannuation

  • Employees earning of $450.00 or more per month will be paid Superannuation by the Employer at the rate of 9.5% of gross wages.
  • Superannuation contributions will be paid to the employees chosen superannuation fund, each and every quarter or more often.
  • In the instance that an employee fails to nominate their chosen superannuation fund, the employer will pay the contributions to the employer’s default fund, in the name of the employee.
  • Contractors will be responsible for their own superannuation contributions.

Obligations for Engagement

  • Upon engagement the Employer and Employee/Contractor will execute a written Agreement/Letter of Agreement outlining the conditions of employment specific to the role and duties the employee is being engaged for. The conditions outlined must include as a minimum: job description, type of engagement, hours to be worked, rate of pay, method of payment.
  • Upon engagement the Employee/Contractor must provide to the Employer the following:
    • Full contact details including emergency contact
    • TFN or ABN (as required)
    • Banking/payment details
    • Super Fund details (employees only)
    • Evidence of membership to the PAA
    • Evidence of any associated qualifications
    • Copy of current resume/biography

Education Currency

  • Currency of education is a professional requirement. The PAA stipulates 15 (Mat Member) or 20 (Full Member) PDP’s (see conditions of PDP’s accumulation) over every two-year period as evidence of maintaining currency of education, knowledge and skills.

Scope of Practice

  • All members and registered organizations (studios and educational bodies) of the Pilates Alliance are required to comply with the PAA Code of Practice relevant to their registration status
  • The employer will display the PAA Code of Practice for members in their staff recess area for staff reference.
  • The employer will display the PAA Code of Practice relevant to the organization in an appropriate area for reference by all persons

Adherence and Compliance with Commonwealth and State/Territory Law, and National Standards

The employer and all staff are required to comply with the following laws relevant to their state and industry:
